Effective Date: September 16, 2025
These Terms and Conditions (“Terms”) form part of your Work Order with Illuminate Toronto (“Illuminate Toronto,” “we,” or “us”). By accepting a Work Order, you agree to be bound by these Terms and the details set out in your Work Order.
Nothing in these Terms limits your rights under the Ontario Consumer Protection Act, 2002.
1. Performance Dates
We will use reasonable efforts to meet any installation, removal, or service dates specified in your Work Order. All dates are estimates only and may be adjusted due to weather, safety concerns, or other circumstances beyond our control.
2. Displays & Services
2.1 We will design and install your holiday lighting or patio furniture wrapping (“Display”) based on your approved Work Order and any photos, descriptions, or instructions you provide.
2.2 If your Work Order is based on photos and we discover property conditions not shown in those photos (e.g., non-standard eaves, gutters, or rooflines), additional charges may apply.
2.3 If you supply your own lights or materials, we cannot guarantee uniformity, bulb orientation, or colour matching.
2.4 For safety reasons, we may refuse to install a Display if:

it would create a hazard for people or property,
-
your property is unsafe for our workers, or
-
adequate power sources are not available.
3. Change Orders
3.1 Once installation has begun, changes requested by you (e.g., design, colour, or placement) may result in additional charges.
3.2 We may make minor adjustments that do not affect the overall design, cost, or performance timeline without seeking your approval.
4. Warranties
4.1 Lights purchased from Illuminate Toronto include a limited seasonal warranty covering defective bulbs, fuses, or wiring. Specific warranty duration will be set out in your Work Order.
4.2 Warranties are void if products are used beyond their rated timeframe (e.g., seasonal lights left installed beyond the recommended period).
4.3 We do not provide warranties on customer-supplied products.
4.4 Damage from vandalism, severe weather, animals, faulty electrical systems, or modifications made after installation is not covered. Repairs will be charged at our standard rates.
4.5 We will obtain your consent before using fasteners that may cause minor surface damage (e.g., staples, hooks). We will take reasonable care, but we are not liable for ordinary wear and tear resulting from installation.
4.6 Except for the warranty above, all other warranties (including implied warranties of merchantability or fitness for purpose) are excluded to the fullest extent permitted by Ontario law.
5. Limitation of Liability
5.1 Illuminate Toronto is not liable for:

damage caused by normal installation methods approved by you (e.g., clips, staples, hooks),
-
inconvenience, loss of enjoyment, or temporary disruption caused by installation or removal.
5.2 We are not responsible for indirect, incidental, or consequential damages (e.g., loss of revenue, profit, or use).
5.3 Our maximum liability is limited to the amount you paid under the applicable Work Order.
5.4 We do not exclude liability for personal injury or death caused by our negligence.
6. Fees & Payment
6.1 Deposits are non-refundable, except as required under the Ontario Consumer Protection Act, 2002.
6.2 Final payment is due upon completion of installation unless otherwise stated in your Work Order.
6.3 Payments not received within [X] days will accrue interest at 2% per month (24% annually) or the maximum permitted by law.
6.4 You are responsible for all applicable taxes (HST and others).
7. Client Responsibilities
You must provide:

safe access to your property,
-
adequate power sources, and
-
accurate information about your property.
We are not responsible for delays or costs resulting from your failure to meet these obligations.
8. Termination
We may terminate this agreement immediately if you fail to pay, breach these Terms, or become insolvent.
9. Ownership of Materials
Lights and materials you purchase from us become your property. Rental equipment and tools remain our property.
10. Photos & Marketing
You grant us permission to take photographs of your completed Display for marketing purposes, provided your address is not disclosed.
11. Force Majeure
We are not liable for delays caused by circumstances beyond our reasonable control, including severe weather, natural disasters, labour disputes, or power outages.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Ontario. Any disputes shall be resolved in the courts of Ontario. Before commencing legal proceedings, both parties agree to attempt good-faith mediation.
13. Severability
If any part of these Terms is found unenforceable, the remainder will continue in effect.
14. Survival
Provisions relating to warranties, limitation of liability, fees, and governing law survive the termination or expiry of this agreement.
